Terms & Conditions

These Terms & Conditions ("Terms") govern your use of propertyleadx.com (the "Site") operated by Property LeadX ("PropertyLeadX", "we", "us"), a Tribe Consulting company. By using the Site you agree to these Terms. Services purchased from PropertyLeadX are governed by a separate client agreement; if these Terms and your client agreement conflict, the client agreement applies.

1. The Site

The Site describes our services and lets you request a call or quote. Information on the Site is provided for general information and may change. We may update, suspend or withdraw any part of the Site without notice.

2. Plans, prices and incentives

Prices shown on the Plans page are in US dollars and are current as of the effective date. They are an invitation to discuss an engagement, not a binding offer; the price, scope and term that apply to you are set out in your client agreement.

The following conditions, also shown on the Plans page, apply to pay-per-lead and pay-per-appointment plans:

  • If a seller becomes unwilling to show the property after the lead has been delivered, the lead will be eligible for replacement.
  • If the client is unable to connect with the seller even once after making reasonable attempts, the lead will be eligible for replacement.
  • The client agrees to promptly notify Property LeadX upon the successful closing of a property sourced through our services.
  • The client agrees to pay the agreed-upon motivational fee, calculated as the specified percentage of the net profit earned from the closed transaction.

3. No guarantee of results

We provide calling, qualification, appointment-setting and related services. We do not guarantee any number of leads, appointments, contracts or closed deals, and nothing on the Site is a promise of results. Any figures, case studies or testimonials describe specific clients' experiences and are not a prediction of yours.

4. Client responsibilities

Clients are responsible for how they use the leads and information we deliver, including compliance with the laws that apply to their own calling, marketing and real estate activities in their state and markets, and for the accuracy of any data they supply to us.

5. The client portal

Access to the client portal at portal.propertyleadx.com is provided to clients under their client agreement. You are responsible for keeping your login details confidential and for all activity under your account. We may suspend access to protect the portal or other clients.

6. Intellectual property

The Site, its content, logos and design are owned by PropertyLeadX or its licensors and protected by copyright and trademark law. You may view and print pages for your own business use. You may not copy, scrape, republish or create derivative works from the Site without our written permission.

Zillow is a trademark of Zillow, Inc. Realtor.com is a trademark of Move, Inc. Google Maps is a trademark of Google LLC. PropertyLeadX is not affiliated with Zillow, Move or Google; names are used only to describe look-up links available in the client portal.

The Site links to and embeds content from third parties (for example YouTube and the TIOS portal). We are not responsible for third-party content or their terms and privacy practices.

8. Acceptable use

You agree not to use the Site to send spam, submit false information, interfere with the Site's operation, attempt unauthorised access, or infringe anyone's rights.

9. Disclaimer and limitation of liability

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site, and we are not liable for any indirect, incidental, special or consequential loss arising from your use of the Site. Liability for services is governed by your client agreement.

10. Governing law

These Terms are governed by the laws of the State of New Hampshire, USA, without regard to conflict-of-law rules. Courts located in New Hampshire have exclusive jurisdiction over disputes arising from the Site, unless your client agreement says otherwise.

11. Changes

We may change these Terms at any time by posting an updated version on this page with a new effective date. Continued use of the Site after a change means you accept the updated Terms.
